HotelBot.com (“HotelBot”) acting as a sales agent for any hotel (“Suppliers”) is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.

HotelBot requires that you agree to the following terms, and by signing this form, you signify your agreement.

HotelBot assumes no responsibility for, and shall not be liable for, any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any bed, pillow, sheets, towels, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under HotelBot’s control; and (4) any Supplier price drop after your hotel bookings have been confirmed, paid in full, or ticketed. You hereby release HotelBot from all claims arising out of any problem covered in this paragraph.

Hotel bookings are subject to supplemental price increases that may be imposed by the Supplier and/or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. By signing below, you are consenting to those terms and conditions.

Because HotelBot is the merchant on your credit card transaction, you agree to the following: HotelBot’s services consist of facilitating the sale and paying the Suppliers, and once HotelBot provides said services, you agree not to dispute the credit card charge. If a Supplier does not provide the service or ceases operations, your only recourse will be against the Supplier. If a Supplier goes bankrupt, your only recourse will be to file a claim with the Supplier’s bankruptcy court.

HotelBot has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, HotelBot recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov.

For medical information, HotelBot recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release HotelBot from all claims arising out of any problem covered in this paragraph. You agree that the courts of the United States will be the exclusive jurisdiction for all claims brought by you or HotelBot, and you hereby submit to the personal jurisdiction of those courts.

The only way to acquire HotelBot’s services is by using a credit card for your purchase so that you can exercise your rights under the Fair Credit Billing Act in case you do not receive the services you purchased from us.

 You, as a customer, are at least 18 years old, possess the legal authority needed to enter into a legally binding transaction, and will only use HotelBot’s services to make legitimate bookings in your name.

Once reservations are confirmed, any modification/alterations initiated by the traveler must be received at least 24 hours in advance of said change and may be subject to additional costs.

In the absence of negligence on HotelBot’s part, HotelBot is not responsible for personal injury or property damage or loss arising out of the act or negligence of any hotel or other person rendering any of the services or accommodations offered herein. The traveler agrees to the foregoing, and also agrees that HotelBot will not be or become liable or responsible for any loss, default, or injury of any person, company, or other legal entity engaged to supply the same.

HotelBot is not to be held responsible for any act, omission or event during the time passengers are not on board of the conveyances provided by HotelBot’s contractors.

HotelBot shall not be held responsible for any loss, injury or damage to person, property, or otherwise, in connection with any accommodation resulting – directly or indirectly – from any Act of God, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferages, epidemics, medical or custom department regulations, defaults, or any other causes over which it has no control.

HotelBot takes no responsibility for losses or expenses due to hotel overbookings, or other hotel related services, sickness, weather, strikes, social and labor unrest, terrorist activities, war, quarantine, or any other causes, actions or omissions, or conditions over which it has no control.
